Abstract

This essay reflects on the (in) effectiveness of educational law against the use of digital technologies for the teaching and learning process of Brazilian public school students in this context of the COVID-19 pandemic. For this, it analyzes the international conception of education for all in UNESCO documents. It also analyzes the Brazilian vision on the field of educational law present in legal provisions - Federal Constitution, Law of Guidelines and Bases of National Education and Common National Curricular Base. The reflections point out that, in the face of this pandemic scenario and the premises of Brazilian educational law, the State is not promoting assistance to students in the public network to carry out the continuation of the teaching and learning process. In this way, it is not guaranteeing the fundamental right of education, contributing to the increase of social inequality, vulnerabilities and reduction of opportunities for learning and the development of technological competence.
